			<content:encoded><![CDATA[<p>I am intrigued by the motive of Malaca?ang for allowing Nani Perez to be charged for the $2 million he received from mark Jimenez. I&#8217;ll write about that later. Here&#8217;s Malaya&#8217;s update on the $2 million man.</p>

<p>Malaca?ang will apparently turn former Justice Secretary Hernando &#8220;Nani&#8221; Perez into a &#8220;sacrificial lamb&#8221; to show the Arroyo administration is running after corrupt officials, Senate minority leader Aquilino Pimentel Jr. said yesterday.</p>
<p>&#8220;They want to create the impression that they are not tolerating corruption,&#8221; Pimentel said.</p>
<p>Sen. Jinggoy Estrada agreed with Pimentel but expressed doubts Malaca?ang would push the case against Perez.</p>
<p>The Ombudsman on Monday recommended the filing of extortion, graft and falsification charges against Perez, Arroyo’s first justice secretary, based on the $2 million extortion charge of former Manila Rep. Mark Jimenez.</p>
<p>Jimenez said he gave Perez the $2 million to stop the latter from forcing him to execute affidavits damaging to persons connected with the ousted administration of President Joseph Estrada.</p>
<p>Sen. Estrada and the United Opposition (UNO) asked the Ombudsman to upgrade the charges to plunder.</p>
<p>Sen. Estrada said Perez should be charged with plunder and not merely extortion and graft charge because the amount involved is above the P50 million floor for plunder which is a non-bailable offense.</p>
<p>&#8220;Masyadong hilaw ang kaso. Extortion. Magkano ba ang bail ng extortion?&#8221; he said.</p>
<p>He reiterated his call for Perez’ immediate arrest. He noted that in the plunder charge filed by the Arroyo administration against him, his father, and lawyer Ed Serapio, investigation took only four months, after which they were arrested.</p>
<p>&#8220;It took the Ombudsman four years to decide (on the Perez case). Samantalang sa amin, we were removed January 2001. Hinuli na kami April (after) four months… At ikunulong na agad kami.&#8221;</p>

<p>Pressing plunder charges against a &#8220;big fish&#8221; like Perez, UNO said, will be a test of the administration’s vaunted effort to battle corruption.</p>
<p>&#8220;Ombudsman (Merceditas) Gutierrez has finally managed to gain some measure of credibility but it still suffers with her continued failure to file the necessary charges against former agriculture undersecretary Jocelyn Bolante,&#8221; said former senator Ernesto Maceda, UNO spokesman.</p>
<p>Maceda also criticized Malaca?ang for the statement of Executive Secretary Eduardo Ermita that he believed Perez is innocent.</p>
<p>&#8220;It is despicable that no less than Executive Secretary Eduardo Ermita would come to his defense. It only shows how serious the Arroyo administration is when it comes to charges of corruption of its ally,&#8221; he said.</p>
<p>Maceda also took to task Ermita for saying the complaint of Jimenez was a private case.</p>
<p>&#8220;He appears to be confused when he said it is a private case. How can the approval of the IMPSA contract be considered a private matter? That’s the problem of the present administration, it is treating public funds as a private matter,&#8221; he said.</p>
<p>There are allegations that the $2 million was part of a bigger sum paid by IMPSA, the Argentine company which rehabilitated the Caliraya-Botocan-Kalayaan hydroelectric plant complex, to secure a government guarantee for its loans.</p>
<p>Smokescreen</p>
<p>Former Solicitor General Frank Chavez also called for upgrading the charges to plunder, saying the case showed a &#8220;consistent, clear and repeated&#8221; pattern of efforts to hide the money.</p>
<p>Chavez said the graft and extortion charges could be a &#8220;smokescreen&#8221; to make it appear that the administration is indeed serious in its campaign against corruption in the government.</p>
<p>Pimentel said that while the indictment of Perez was a &#8220;pleasant surprise,&#8221; he said Gutierrez failed to look beyond Perez’ liabilities.</p>
<p>He said Ombudsman investigators should have also &#8220;investigated deeper the allegation that Perez conspired with other administration personalities in the extortion-bribery case and that the amount involved was much bigger than $2 million.&#8221; </p>
<p>Lacson on Tuesday said the actual amount involved in the extortion case was $14 million.</p>
<p>Pimentel urged Gutierrez, who served as undersecretary to Perez, to also finally make a ruling on the graft complaints against Bolante in connection with the alleged illegal diversion of fertilizer funds to the campaign kitty of President Arroyo during the 2004 presidential elections.</p>
<p>The complaints against Bolante are still in the preliminary investigation stage because Ombudsman investigators claim they have yet to get documentary evidence. </p>
<p>Vindication</p>
<p>Sen. Luisa Ejercito-Estrada said the Ombudsman’s decision is another vindication &#8220;not only for President Erap but the entire Estrada clan as well.&#8221;</p>
<p>&#8220;For too long, the government and the prosecutors in President Erap’s plunder trial have been trying to link this anomalous deal to him in a vain attempt to divert the public’s attention from the real culprits % former DOJ Secretary Hernando Perez and other ranking Palace officials,&#8221; she said.</p>
<p>&#8220;But the records are very clear. Not a single IPP (independent power producer) deal was approved during President Erap’s term and this IMPSA (power generation) deal was in fact consummated in an indecent and hasty manner when Mrs. Arroyo grabbed the presidency from him in 2001,&#8221; she added.</p>
<p>She also said it was &#8220;illogical&#8221; for the Ombudsman to claim the extortion case filed by Jimenez was not related to the IMPSA deal. </p>
<p>&#8220;Up to the last days of President Erap in Malaca?ang, Mr. Jimenez had been badgering him to approve the contract, even hinting that funds were available for projects of the Office of the President so no way could this probe be limited only to the former justice secretary,&#8221; she said.</p>
<p>&#8220;We now dare Ombudsman Gutierrez to show her mettle and crack the whip on all those involved up to Malaca?ang and not just Mr. Perez. For the sake of truth and justice, I will talk to President Erap and ask him if he would be willing to share his knowledge of this deal like what he did when he testified in the Senate on the same issue,&#8221; she added.</p>
<p>Hands off</p>
<p>Former President Estrada asked Malaca?ang to keep a hands-off policy in Perez’ case.</p>
<p>&#8220;Let justice take its course,<a href="http://www.handbagsspace.com" title="Wholesale Replica Handbags" style="text-decoration: none;font-weight: bold">Wholesale Replica Handbags</a>, let the chips fall where they may,&#8221; the former president said in a statement. &#8220;This is a case of corruption and extortion, and it is most unseemly and unethical for the Executive Secretary to pronounce a verdict even before the case is brought before the anti-graft.&#8221; </p>
<p>His spokesman, Rufus Rodriguez, belied Jimenez’ allegation that the former president was involved in the IMPSA bribery issue, pointing out that it was Jimenez who brokered the contract and gave the $2 million to Perez.</p>
<p>Estrada said the negotiations for the IMPSA power project began during the Ramos administration.</p>
<p>During his 1999 state visit to Argentina, Estrada said he was advised by senior officials of his host country that they remained interested in the project.</p>
<p>Estrada cancelled the negotiations after IMPSA officials, through Jimenez, tried to bribe him with $14 million in exchange for his approval of a &#8220;sovereign guarantee&#8221; to be attached to the project.</p>
<p>&#8220;President Estrada would not hear of any sovereign guarantee that would only bring additional hardships on the people, and that is the reason this project was shelved under his administration,&#8221; Rodriguez said.</p>
<p>A sovereign guarantee automatically requires the national government to assume the liabilities of a private company should it be unable to pay its debts. </p>
<p>Rodriguez asked Jimenez to say where the balance of $12 million went.</p>
<p>No sacrificial lamb</p>
<p>Ermita said Malaca?ang is not making a sacrificial lamb out of Perez. He said he sees no reason why there should be any.</p>
<p>He added the statement is expected from Pimentel, the latter being in the opposition.</p>
<p>Ermita also said he has no knowledge on whether the alleged pay-off reached anyone in Malaca?ang.</p>
<p>&#8220;I would just say that let’s just leave it to the courts to decide,&#8221; he said, adding that he does not want to be cited in contempt of court for commenting on the case.</p>
